It is apparent from the order passed by this Court, during the course of motion hearing, on 20.5.2004, that the petitioner acknowledged that his claim for regularisation was not justified. The only other claim raised in the instant writ petition pertains to the offer to the petitioner to appoint him on contract basis as against the service presently being rendered by the petitioner on work charge/daily wage basis. Learned counsel for the respondents has pointed out that the petitioner was merely offered appointment on contract basis by taking a sympathetic view in his favour.
However, if he is disinclined to accept the same, he shall not be appointed on contract basis in furtherance of the offer made to him through letter dated 6.5.2004 (Annexure P1).
In view of the statements made by the learned counsel for the CWP NO. 7897 of 2004 2
parties, we hereby direct the respondents not to appoint the petitioner on contract basis in furtherance of the offer made to him vide communication dated 6.5.2004 (Annexure P1).
Disposed of accordingly.
