It is an admitted fact that application of the petitioner to set aside ex parte judgment and decree passed against him is pending before the Debt Recovery Tribunal at Chandigarh and now fixed for October 6, 2006.
In this writ petition, it is prayer of the petitioner that a writ of mandamus be issued directing respondent No. 2 not to conduct sale of his property, till above mentioned application is disposed of by the Tribunal. It has been conceded by counsel for respondent No. 1 that the Tribunal has granted stay of confirmation of sale of the property of the petitioner. He further states that till disposal of that application, respondent No. 1 shall not ask for vacation of stay. In view of concession given, this writ petition is disposed of with a direction to the Tribunal to decide application of the petitioner on the date fixed or may be within two dates thereafter.
