Vide order dated 24.5.1982, decision of this writ petition was kept pending to await, determination of surplus area of the petitioners.
Order passed by the Financial Commissioner on 28.4.1999 which has been placed on record, by the petitioners, by making an application, indicates that for determination of surplus area, the proceedings are still going on. In view of this, at this stage, this Court feels that no effective order can be passed so far as the controversy in this writ petition is concerned.
Accordingly, this writ petition is ordered to be adjourned sine die.
However, Assistant Collector, Abohar is directed to proceed further and determine the surplus area matter of the petitioners. Parties are directed to appear before the Collector, Abohar on 8.3.2006 and if the matter has not already been decided, the Collector shall give specific findings, regarding C.W.P. No.3075 of 1972 
land, which was allotted to the respondents, whether it falls within the surplus area of the land-owner or not. Collector is further directed to dispose of the matter within six months from the date of receipt of copy of this order.
Put up for hearing as and when necessary application is made by any of the parties.
Copy of the order be supplied dasti on payment of usual charges.
