for the petitioner.
Petitioner Kamal Setia apprehending his arrest in a non- bailable offence in case FIR No.446 dated 10.9.2006 registered under Sections 420/494/495/496/506 IPC at Police Station Phase I, Mohali, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
As per the allegations in the aforesaid FIR, the petitioner by concealing the fact of his earlier marriage, performed marriage with the complainant by representing that he was a bachelor. A child was born from the second marriage. Subsequently, the complainant came to know about the factum of the previous marriage of the petitioner.
After hearing the counsel for the petitioner and keeping in view the nature of the offence and the allegation that the life of the complainant has been spoiled, I am of the opinion that the petitioner does not deserve the concession of anticipatory bail.
