Petitioner Jaggu has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No.106 dated 26.5.2006 registered under Sections 323/324/148/149/326 IPC at Police Station Phillaur.
I have heard the counsel for the parties and gone through the contents of the FIR.
This order be read in continuation of the earlier order dated September 29, 2006 passed by this Court.
Counsel for the petitioner contends that in terms of the aforesaid interim order, the petitioner has joined the investigation. This fact has not been disputed by the State counsel and he further on instructions from HC Pirthi Raj states that during the investigation the allegations levelled in the aforesaid FIR were found false by the DSP and a cancellation report has been recommended.
In view of the above and for the reasons stated in the interim order dated September 29, 2006, the same is made absolute on the same terms and conditions.
Disposed of accordingly.
