The plaintiff having concurrently lost before both the Courts below has approached this Court through the present Regular Second Appeal. He filed a suit for declaration claiming that his date of birth is infact December 27, 1944 and due to a bonafide mistake his date of birth was recorded as June 6, 1942.
Both the Courts below have rejected the claim of the plaintiff. It has been found that the plaintiff has failed to lead any evidence to substantiate his claim. The plaintiff was to retired w.e.f. June 2000, and therefore, he had filed a suit on April 19, 1996 i.e. the fag end of his carrier. The suit filed by the plaintiff was dismissed by the learned trial Court and appeal filed by him failed before the learned First Appellate Court.
R.S.A. No. 2094 of 2002 
Nothing has been shown that the findings recorded by both the Courts below suffer from any infirmity or are contrary to record.
No question of law, much less any substantial question of law, arises in the present appeal.
