Manjit Kaur v. State of Punjab - CRM-46828-m-2006 RD-P&H 8282 (10 October 2006)
Crl.Misc.No.46828 -M of 2006
DATE OF DECISION: OCTOBER 16, 2006
State of Punjab
CORAM: HON'BLE MR.JUSTICE SATISH KUMAR MITTAL
Present: Mr. Satinder Khanna, Advocate,
for the petitioner.
Mr.N.S.Gill, AAG, Punjab.
Mr.Sunil Chadha, Advocate,
for the complainant.
Petitioner Manjit Kaur has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.199 dated 23.6.2006 registered under Sections 406/420/467/468/120-B IPC at Police Station Jagraon, District Ludhiana.
I have heard the counsel for the parties.
Undisputedly, the petitioner, who is in custody since 27.6.2006, is neither the owner of the disputed land nor the signatory to the alleged agreement. She was only present in her house at the time of the alleged occurrence and the allegation against her is that she also conspired with the other accused.
Keeping in view the aforesaid facts and the custody period, I deem it appropriate to grant regular bail to the petitioner and she is accordingly ordered to be released on bail to the satisfaction of the trial Court.
