IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
Civil Revision No. 5408 of 2006
Date of Decision: 16.10.2006
Roop Lal ...Petitioner
Raghubir Chand ...Respondent
CORAM Hon'ble Mr.Justice Vinod K.Sharma
Present: Mr.Kamal Kant Verma, Advocate,
for the petitioner.
Vinod K.Sharma, J. (Oral)
Present revision petition has been filed against the order dated 29.8.2006 passed by the learned Civil Judge (Senior Division), Panchkula dismissing the objection filed by the petitioner against the attachment of his share in the property bearing No.768/1, Gandhi Chowk, Kalka.
CR No. 5408 of 2006 2
The contention of the learned counsel for the petitioner is that the property of the petitioner possession of which was taken by the Executing Agency was sufficient to satisfy the demand of mesne profits.
This contention of the learned counsel for the petitioner has rightly been rejected by the Executing Court as the order shows that the articles taken over from the premises in dispute were totally worthless and were not sufficient to satisfy the decree.
Thus, there is no error in exercise of jurisdiction by the trial court which may call for interference by this Court in revisional jurisdiction.
