Petitioner Jagjit Singh apprehending his arrest in a non-bailable offence in case FIR No.110 dated 29.3.2001 registered under Sections 420/465/467/471/120-B IPC at Police Station Kotwali, Kapurthala, has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail.
I have heard the counsel for the parties and gone through the contents of the FIR.
This order be read in continuation of the earlier order dated August 28, 2006 passed by this Court.
Counsel for the petitioner contends that the allegation against the petitioner, who is real brother of the complainant, is that he along with his another brother forged general power of attorney of the complainant in the year 1988 and sold the grinding machine belonging to the complainant.
Counsel contends that though the petitioner has been declared proclaimed offender but he was not having any knowledge of the registration of the aforesaid FIR against him nor he received any notice in the case. Counsel further contends in terms of the aforesaid interim order, the petitioner had appeared before the trial Court and furnished his regular bail bonds which have been accepted and attested and since then he is regularly appearing.
In view of the above, the interim order dated August 28, 2006 is made absolute.
Disposed of accordingly.
