This order shall dispose of two Crl. Misc. Nos. 52206-M of 2006 and 55295-M of 2006 filed by Kaptan and Chainu alias Dharmender, respectively, under Section 439 Cr.P.C. for the grant of regular bail in case FIR No. 179 dated 6.8.2006 under Section 304 IPC, registered at Police Station Chhainsa, District Faridabad.

I have heard counsel for the parties and gone through the contents of the FIR.

It has been alleged that one Kallu Ram was sailing the boat in a negligent manner due to which four persons died by drowning in the river.

Counsel further contends that as far as the petitioners are concerned they have nothing to do with the alleged incident. They are the brothers of the contractor Babbar, which was being driven by Kallu Ram. Counsel further contends that at the most the offence as per the FIR falls under Section 304-A IPC and that too against Kallu Ram.

The petitioners are in custody since 7.8.2006. Challan has been filed but charges have not been framed. Trial is not likely to conclude soon.

Keeping in view the aforesaid facts and without expressing anything on the merits of the case, I deem it appropriate to grant regular bail to the petitioners and they are accordingly ordered to be released on bail subject to their furnishing bail bonds to the satisfaction of trial Court.
