Petitioner Sukhdev Singh has filed this petition under Section 482 of the Code of Criminal Procedure for quashing of complaint dated 31.10.2002, titled as Karnail Singh versus Sukhdev Singh and another, under Sections 324, 34 IPC, pending in the Court of Judicial Magistrate Ist Class, Moga, and all the subsequent proceedings.
I have heard counsel for the petitioner.
On the complaint made by the respondent, an FIR was registered against the petitioner, but the police did not found the allegations to be true and submitted the cancellation report. Thereafter, the respondent has filed the aforesaid complaint, in which the petitioner has been summoned.
Keeping in view the allegations against the petitioner and the preliminary evidence led by the complainant, no ground for quashing the complaint and the summoning order is made out.
