The petitioner has filed the instant petition under Article 226 of the Constitution for issuance of a direction to the respondents to consider him for absorption against the vacant posts of Junior Engineers.
Having heard the learned counsel for the parties we are of the considered view that no such directions could be issued for absorption of the petitioner against the vacant posts of Junior Engineers in view of the Constitution Bench judgment of Hon'ble the Supreme Court in the case of Secretary, State of Karnataka v. Umadevi, (2006) 4 SCC 1 as well as a detailed judgment of this Court in the case of Rajinder Kumar v. State of Haryana, 2006 (2) PLR 474.
Therefore, the instant petition fails and the same is dismissed.
