The prayer made in the writ petition is for issuance of direction to the respondent Department to forward the application of the petitioner for appointment as Care Taker Associate N.C.C. Officer to the Commanding Officer, 15rh Haryana Battalion NCC, Jind (respondent No.5) keeping in view the relevant provisions of National Cadet Cores (Girls Division) Rules, 1949, with a further direction to allow the petitioner to take training C.W.P. No. 16588 of 2006 [2]
for becoming a NCC Officer as she fulfils all the requisite eligibility conditions/ qualifications for appointment as Care Taker Associate NCC Officer under Rule 13 of the aforesaid Rules.
For the aforementioned relief claimed in the present writ petition, the petitioner has already represented to the respondents vide representation dated 30.8.2006 (P-3).
Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the representation sent by the petitioner and decide the same expeditiously preferably within a period of two months from the date a certified copy of this order is presented to them. If the claim of the petitioner is found to be meritorious and decided in her favour then the benefit accruing to the petitioner shall be given within a further period of two months thereafter. It shall be appreciated if a speaking order is passed.
Petition stands disposed of in the above terms.
