Petitioner Gurmeet Kaur claiming herself to be wife of Lakhwinder Singh, while apprehending her arrest in a non-bailable offence in case FIR No. 158 dated 2.8.2006 under Sections 419/420/466/468/471/ 120-B IPC, registered at Police Station Qilla Lal Singh Batala has filed this petition under Section 438 of the Code of Criminal Procedure for the grant of anticipatory bail.
I have heard the arguments of learned counsel for the parties and gone through the contents of the FIR.
As per the prosecution version, Ajit Singh got employment by playing fraud and on the certificate of his brother Lakhwinder Singh in the name of Lakhwinder Singh. He had died on 11.6.2004. After his death, the petitioner claimed herself as widow of Lakhwinder Singh and got widow pension and other benefits of the deceased. During investigation, it has been found that Lakhwinder Singh, husband of the petitioner, is alive and she has obtained benefits from the Government by playing fraud as widow of Lakhwinder Singh. Keeping in view the nature of allegations and material collected during investigation, I am not inclined to grant the discretionary relief of anticipatory bail to the petitioner.
