for the petitioner.
Through the instant writ petition, the petitioner has impugned the order dated 15.5.2006 (Annexure P/11), wherein it is repeatedly reiterated that the services of the petitioner were ordered to be regularized by the award of the Labour Court dated 22.7.2004 with effect from 26.09.1993.
Learned counsel for the petitioner has invited our attention to the aforesaid award of the Labour Court, which has been appended to the instant writ petition as Annexure P/1, so as to demonstrate that there is no such finding recorded by the Labour Court. It is, therefore, vehemently contended that the order passed by the Executive Engineer, Provincial Division No.1, Building and Roads Division, Bathinda, is without application of mind.
Learned counsel for the petitioner has also invited our attention to the policy instructions dated 23.01.1995 (Annexure P/8) in order to demonstrate that employees who had rendered 10 years of service as on 30.11.1994 were entitled to regularization with effect from 30.11.1994. So as to demonstrate that the petitioner had rendered 10 years of service as on 30.11.1994, learned counsel for the petitioner has invited the Courts attention to paragraph No. 9 of the award of the Labour Court dated 22.7.2004 (Annexure P/1) and more particularly to sub paragraph (b) thereof.
