Petitioner Gram Panchayat has filed this writ petition with a prayer to quash order dated 25.9.2006 (Annexure P/4), vide which, an Administrator has been appointed to carry out development works in the village. By referring to resolution dated 26.9.2006 (Annexure P/1), counsel submits that majority of the Panches are supporting the Sarpanch. If that is so, in view of para 5 of the order, under challenge, the petitioner is at liberty to show this resolution and also affidavits of the Panches, to the Block Development and Panchayat Officer concerned, who shall immediately withdraw the Administrator, as has been directed by the District Development and Panchayat Officer, in his order dated 25.9.2006.

In view of facts mentioned above, this writ petition is disposed of with liberty to the petitioner to approach the Block Development and Panchayat Officer, who is directed to act as per directions given to him in order Annexure P/4 forthwith.

Copy of the order be given dasti on payment of usual charges.
