Respondents No.1 to 3 filed RSA No.1701 of 1985 in which this Court passed an order dated 23.09.1985 whereby status quo was directed to be maintained till further orders. While admitting the appeal on 15.10.1985, this Court further passed a specific order that the status quo regarding possession shall be maintained.
Alleging non-compliance of the aforesaid interim order, the petitioner, who was respondent No.1 in the above said RSA, has filed this contempt petition averring that notwithstanding the direction to maintain status quo, the respondents have executed a sale deed on 2.7.1992 and handed over possession to the vendees thereby violating the afore- mentioned interim order passed by this Court. Vide an order dated 26.11.2002, this petition was directed to be taken up for hearing along with RSA No.1701 of 1985.
COCP No.937 of 1992 -: 2 :-
The above said RSA has since been dismissed by this Court vide judgment dated 14.11.2005.
The petitioner has already filed execution proceedings which are stated to be pending before the Executing Court.
Having regard to the fact that the controversy between the parties shall stand resolved only with the disposal of the execution proceedings, this petition is disposed of with a direction to the Executing Court to expedite the execution proceedings and conclude the same on or before January 31, 2007.
