This contempt petition has been filed by the petitioners on the apprehension that, as per some media reports, the shop which is in the possession of the petitioners is likely to be demolished by the respondents on the pretext of removal of encroachment.
It is contended that since the learned Additional District Judge, Faridabad, vide his order dated 26.4.2006, has restrained the respondents from interfering in possession of the petitioners and in the revision petition, which the respondents have preferred in this court, the only interim direction is to restrain the petitioners from raising further construction and, thus, the order dated 26.4.2006 passed by Additional District Judge, Faridabad to the extent of restraining the respondents from interfering in possession of the petitioners is still operative, the proposed action of the respondents amounts to commission of contempt of court.
After hearing Learned Counsel for the petitioners and having COCP No.1309 of 2006 -: 2 :-
regard to the fact that no step to demolish the shop in possession of the petitioners has been taken by the respondents so far, this petition is dismissed being premature, at this stage.
