The petitioners filed CWP No.14792 of 2002 for the grant of higher revised pay scales. The said writ petition was allowed in terms of an earlier Division Bench judgment of this Court passed in CWP No.1701 of 2000, decided on 21.6.2001. The said writ petition was allowed on October 17, 2003.

Alleging non-compliance of the above said order, this contempt petition has been filed.

In response to the show cause notice, affidavit has been filed by the then Higher Education Commissioner, Haryana, Mr. Dhanpat Singh, as well as the then Principal Secretary to Govt. Haryana, Education Department, Mr. M.L. Tayal.

Shri R.D. Sharma, learned Dy. AG, Haryana, has also placed on COCP No.1474 of 2004 -: 2 :-

record a copy of the letter dated 14.10.2006 sent by the University to the State Govt., which indicates that the requisite pay scales have already been granted to the petitioners w.e.f. 1.1.1986 and 1.1.1996 respectively and they are drawing their pay as per those revised pay scales. The letter further indicates that no arrears are required to be paid to the petitioners. However, the release of the aforesaid pay scale to the petitioners was provisional and has yet not been regularized due to non-grant of the sanction by the State Govt. though the University's highest body, i.e., the Executive Council has already resolved in their favour. It further appears that the State Govt. has now accorded the necessary sanction.

In this view of the matter, this petition is disposed of with a direction to the competent authority to issue the formal orders regularizing the grant of requisite pay scales to the petitioners within a period of two months from today.

Disposed of.

Rule discharged.
