In response to the order dated August 11, 2006, an affidavit has been filed by Umed Singh, Land Acquisition Collector, Public Works Department (B&R), Haryana, Ambala Cantt. In para 7 of the said affidavit, it has been stated that the reference under Section 28-A(3) of the Land Acquisition Act, 1894 was made to the District Judge, Karnal vide memo No.58 dated 30.5.2005 (Annexure R-1) which has been decided by the learned District Judge vide judgment dated 20.9.2005, a copy of which has been appended as Annexure R-2. In the affidavit, it is further averred that Form-B in respect of enhanced compensation has also been sent by the Land Acquisition Collector to the Executive Engineer concerned vide memo dated 28.11.2005 (Annexure R-3).
In this view of the matter and having regard to the fact that the COCP No.1563 of 2004 -: 2 :-
order dated April 22, 2004 passed by this Court has already been complied with by the respondents, no further action is called for.
Consequently, this petition is disposed of.
