Petitioner Balbir Singh, who claims himself to be father of mortgagor, has filed this petition under Section 482 of the Code of Criminal Procedure for registration of FIR against respondents No.4 to 9, including Shri Bhupinder Singh, Sub Divisional Magistrate, Ferozepur (respondent No.4), who has dismissed the application filed by son of the petitioner for redemption of the mortgage.
I have heard counsel for the petitioner and gone through the contents of the petition.
It has been alleged that a written complaint was filed by the petitioner before Senior Superintendent of Police, Ferozepur for registration of the case against the said officer, but the said complaint was not taken care of and FIR has not been registered. It has been stated that the said officer has made distortion in the order with intention to help the other side.
After hearing counsel for the petitioner, I do not find any ground to issue the aforesaid direction, as in my opinion no offence has been committed by the aforesaid officer, while deciding the application for redemption filed under the Redemption of Mortgage (Punjab) Act, 1913, which is a quasi judicial order. If an adverse order is passed against a party, the right of appeal has been provided in the said Act.
