The petitioner has filed this petition under Section 482 of the Code of Criminal Procedure for quashing of FIR No. 26 dated 5.4.2006 under Sections 420, 365, 120-B IPC, registered at Police Station Kumb Kalan, District Ludhiana.
I have heard counsel for the petitioner and gone through the contents of the petition as well as the FIR.
The petitioner in this case is raising disputed questions of facts.
Since the allegations in this case prima facie constitute the alleged offence, therefore, on the basis of disputed question of law that the petitioner has been falsely implicated in this case, the FIR cannot be quashed.
Dismissed.
