Through the instant writ petition, the petitioner has impugned the order dated 23.11.2005 (Annexure P11) by which the petitioner had been transferred from Drainage Sub Division, Nasrala, Hoshiarpur to Canal Sub Division, Nawanshahar. While issuing notice, the operation of the impugned transfer order was stayed qua the petitioner. The official respondents have filed a joint written statement, wherein they have appended a representation submitted by the petitioner on 28.4.2006 as Annexure R1. A perusal of the averments made in the short affidavit filed on behalf of the respondents reveals that having examined the claim raised by the petitioner in her representation, the respondents have no objection in allowing the representation of the petitioner, to continue at Drainage Sub Division, Hoshiarpur. In view of the aforesaid factual position, we are satisfied that the respondents have accepted the claim of the petitioner.
In view of the above, the impugned transfer order dated 23.11.2005 (Annexure P11) qua the petitioner, is hereby set aside.
Allowed in the aforesaid terms.
