The petitioner has filed this petition under Section 482 Cr.P.C.
for quashing of the complaint dated 16.8.2002 filed by the complainant before the Ilaqa Magistrate, Khanna under Section 3 of Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act, 1989 read with Section 366, 354,506 and 511 IPC.
From the last two dates, no one is appearing on behalf of the petitioner. Today also, no one is present on behalf of the petitioner.
It appears that in the aforesaid complaint, summoning order has not been passed. In this case, regarding the same occurrence, the matter was investigated in case FIR No. 142 dated 21.8.2001, registered at Police Station City Khanna, District Ludhiana and after investigation, the police filed a cancellation report, which has been accepted by the Court on 29.11.2004.
In view of the aforesaid fact, I do not find any ground to quash the aforesaid complaint at this stage.
