In this writ petition, challenge is to the orders Annexures P/2 and P/3. After hearing counsel for the petitioner, we feel that the petitioner can lay challenge to these documents, before the State Transport Appellate Tribunal, by filing an application under Section 90 of the Motor Vehicles Act, 1988.
This writ petition is disposed of with a direction to the appellate Tribunal to decide application of the petitioner, if any moved within three weeks from today. The bar of limitation shall not be taken up against the petitioner. It is further made clear that the Tribunal shall look into contents of orders Annexures P2 and P/3 and if the same have not been passed in accordance with the provisions of aforesaid Act, it will be at liberty to pass an appropriate order.
