Sham Sunder v. Dinesh Yadav & Ors - COCP-761-2006 RD-P&H 8984 (19 October 2006)
C.O.C.P. No.761 of 2006
Date of Decision:- 30.10.2006
Sham Sunder ....Petitioner
Dinesh Yadav & others ....Respondents
Mr.Gaurav Mohunta, Advocate
CORAM:-HON'BLE MR.JUSTICE SURYA KANT
SURYA KANT, J.
Vide an interim order dated 17.8.1999 (Annexure P-1) passed in Civil Miscellaneous No.5267-C of 1999 in R.S.A.No.3086 of 1999, this Court had restrained the respondents from demolishing the alleged Marhi, which was being allegedly worshipped by the petitioner, till further orders.
Alleging that in violation of the above-stated interim order the respondents were attempting to demolish the Marhi, this contempt petition has been filed.
In response to the show cause notice, an affidavit has been filed on behalf of the respondents in which a positive stand has been taken that no attempt is being made to demolish the Marhi rather the entire area is being beautified. The stand taken by the respondents is apparently correct as can be seen from the photographs (Annexures P2 & P-3).
In this view of the matter, no action is called for in this petition and the proceedings are accordingly dropped.
