The present revision petition has been filed against the order dated 22.9.2005 passed by the learned Civil Judge (Sr. Divn.),Karnal vide which the evidence of the petitioner has been ordered to be closed after availing eleven opportunities including the last opportunity.
Learned counsel for the petitioner submits that in the interest of justice, the petitioner may be granted only one opportunity to lead his entire evidence.
Without going into the merits of the case, I feel that interest of justice would be served if the petitioner is granted one opportunity to lead his entire evidence on payment of costs. Accordingly, the present revision is C.R.No. 5671 of 2005 [2]
allowed, the impugned order is set aside and the petitioner is granted one last opportunity to lead his entire evidence on the date to be fixed by the trial Court. However, this shall be subject to payment of Rs. 5000/- as costs.
