Petitioner Raj Kumar has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.37 dated 7.7.2006 registered under Sections 7/13 of the Prevention of Corruption Act, at P.S.
S.V.B. (H), Rohtak.
I have heard the arguments of the learned counsel for the parties.
Counsel for the petitioner contends that the allegation against the petitioner is that he had demanded an amount of Rs.4500/- for entering the mutation and supplying its copy. Counsel further contends that the mutation was already entered on 21.5.2006 and sanctioned on 15.6.2006 by the Tehsildar, i.e., one month prior to the making of the complaint. Counsel contends that the petitioner is only Patwari and is not the sanctioning authority. Counsel further contends that the petitioner is in custody since 7.7.2006 and in this case only charge has been framed and the prosecution evidence will be led on 12.1.2007. The trial is not going to conclude soon.
Keeping in view the aforesaid facts, I deem it appropriate to grant regular bail to the petitioner, and he is accordingly ordered to be released on bail to the satisfaction of the trial Court.
