Petitioner Surjit Singh has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.21 dated 19.1.1988 registered under Sections 61 1/14 of the Excise Act at Police Station Samana, District Patiala.
I have heard the counsel for the parties.
The petitioner is facing the magisterial trial in the aforesaid FIR, which was registered in the year 1988. He is in custody since 26.7.2006. Counsel for the respondent-State, on instructions from HC Swatanter Bhan, states that till date no prosecution witness has been examined. The trial is not going to conclude soon.
Keeping in view these facts, I deem it appropriate to grant regular bail to the petitioner, and he is accordingly ordered to be released on bail to the satisfaction of the trial Court.
