Notice of motion to the respondents.

On the asking of Court, Shri Sukhdip Singh Brar, Additional Advocate General, Punjab accepts notice on behalf of the respondents.

Copies of the writ petition have been supplied to the learned counsel for the respondents.

The petitioner has approached this Court for issuance of directions to respondent No.2, District Magistrate- cum-Deputy Commissioner, Ludhiana to issue no objection certificate for the proposed retail outlet at village Pakhowal, Tehsil Raikot, District Ludhiana. According to the petitioner, an application dated June 18,2005 (Annexure P.2) has been filed in this regard but the said application remains unresponded so far.

In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to the District Magistrate-cum- Deputy Commissioner, Ludhiana, respondent No.2 to take a final decision on the application (Annexure P.2) within a period of one month from the date a certified copy of this order is received, by passing a detailed and speaking order and takes such further appropriate action as may be required, in accordance with law.

A copy of the order be given dasti on payment of usual charges.
