After arguing the case for some time, the learned counsel for the petitioner wishes to withdraw the present petition with a liberty to the petitioner to file a fresh petition on the same cause of action by giving better particulars with regard to the reasons for filing the appeal after a delay of 323 days before the appellate authority.

Dismissed as withdrawn with liberty, as aforesaid.
