The petitioner society has approached this Court for issuance of directions to the respondents to make the payment of the works alleged to have been executed by the petitioner.
From the perusal of the record, we find that for the claim which has been made by the petitioner society in the present petition, it has already served a legal notice dated October 8, 2005 (Annexure P.1) which remains unresponded so far.
In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to the Executive Engineer, Bathinda Canal Division, Bathinda, respondent No.3 to take a final decision on the aforesaid legal notice (Annexure P.1) within a period of four months from the date a certified copy of this order is received, by passing a detailed and speaking order and takes such further appropriate action, as may be required, in accordance with law.
A copy of the order be given dasti on payment of usual charges.
