The petitioner has challenged the order dated February 21, 2005 Annexure P-3 and dated July 29, 2005 Annexure P-4 and also the orders dated August 4, 2005 Annexure P-5 whereby the pay scale of Rs.
4000-6000 of the petitioner has been withdrawn and his pay been re-fixed from the scale of Rs.4000-6000 to Rs. 3050-4590 and a recovery of the excess amount has been ordered against him. The primary grievance of the petitioner is that before passing the aforesaid orders, the petitioner had not been granted any opportunity nor any show cause notice was issued.
In the written statement, the respondents have maintained that the petitioner submitted two undertakings dated October 30, 1998 whereby he had undertaken to abide by the decision of the Government with regard to revision of pay and had also undertaken to refund the excess amount.
In view of the stand taken by the respondents and keeping in view the undertaking given by the petitioner, we are satisfied that no interference in the present petition is made out .
