The present Regular Second Appeal has been filed by the State of Haryana against concurrent findings recorded by the courts below. A reading of the judgments of the courts below would show that by a circular dated 12.8.1998 the limit of encashment of unutilised earned leave had been increased from 240 days to 300 days. This circular was enforced with effect from 1.7.1997. The plaintiff had retired on 31.7.1998. He was therefore entitled to 300 days encashment of earned leave. It was further found that there was unutilised earned leave of more than 300 days to the credit of the plaintiff during the period 1990-1998. It is on this ground that R.S.A.No.3846 of 2006 2
the claim of the plaintiff for leave encashment for 300 days has been granted.
I find no error in the findings recorded by the courts below.
No substantial question of law arises for determination in this Regular Second Appeal. The same is therefore dismissed in limine.
