Petitioner Gurmit Singh has filed this petition under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 134 dated 14.5.2006 under Sections 397, 333, 186 IPC, registered at Police Station City Hoshiarpur.
I have heard counsel for the parties and gone through the contents of the FIR.
In this case, the petitioner is in custody since 15.5.2006.
Counsel for the petitioner states that after investigation, the challan has been filed, but charge has not been framed so far. He further contends that the main accused in this case are Ramandeep Singh and Gobind Singh, against whom there are allegations of causing injuries and snatching carbine of the police official. Counsel contends that there is no specific allegation against the petitioner. Counsel for the respondent-State does not dispute the fact that the main accused in the case are Ramandeep Singh and Gobind Singh.
Keeping in view the aforesaid facts, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
