The petitioners have filed this petition under Section 439 Cr.P.C. for the grant of regular bail in case FIR No. 118 dated 1.8.1988 under Sections 506/382/148/149 IPC and Section 25/54/59 of the Arms Act, registered at Police Station City Phagwara.
I have heard counsel for the parties and gone through the contents of the FIR.
The petitioners are facing Magistrate trial in the aforesaid case, which was registered in the year 1988. They were declared proclaimed offender in the year 1991 and now they have been arrested and are in custody since 31.7.2006
In this case, no prosecution witness has been examined so far.
Trial is not likely to conclude soon.
Keeping in view the aforesaid facts, without expressing anything on the merits of the case, I deem it appropriate to grant regular bail to the petitioners subject to their furnishing heavy surety with an undertaking that they will not indulge in similar activities and they are accordingly ordered to be released on bail subject to their furnishing bail bonds to the satisfaction of trial Court.
