The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 63 dated 25.9.2005 under Sections 420120-B IPC, registered at Police Station City Kotkapura, District Faridkot.
I have heard counsel for the parties and gone through the contents of the FIR.
The petitioner is in custody since 26.8.2006. The co-accused of the petitioner have already been acquitted by the trial Court on the basis of the compromise. The petitioner has also paid the amount of his share but subsequently he did not appear before the trial Court, therefore, he has been declared proclaimed offender and now he has been arrested and is in custody. Trial is not going to conclude soon.
Keeping in view the aforesaid facts and without expressing anything on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of trial Court.
