Dispute in this writ petition pertains to non-payment of electricity charges/ alleged theft by the petitioner. Counsel for the petitioner very fairly states that in view of the ratio of Full Bench Judgment in Ranbaxy Laboratories Ltd. v. Punjab State Electricity Board and another, 2004(1) Recent Civil Judgments 626, let liberty be granted to the petitioner to file civil suit.
To the prayer made, no objection has been raised by counsel for the respondents. Accordingly, this writ petition is disposed of and liberty is granted to the petitioner to file a civil suit. If any civil suit is filed within three weeks from today, recovery of 1/3rd of the disputed amount
shall remain stayed till then and thereafter, the petitioner may move an application before the civil court for getting interim relief.
Copy of the order be given dasti on payment of usual charges.
