This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of mandamus directing the respondents to treat the petitioners eligible for promotion to the post of Hindi Teacher keeping in view their academic qualification of Parbhakar and Diploma in J.B.T. Course, with effect from the due date or with effect from the date their juniors have been promoted by the respondent department. For the relief claimed in the instant petition, the petitioners have already sent a legal notice, dated 12.9.2006 (P-4) to the respondents. Learned CWP No. 16920 of 2006

counsel for the petitioners has also placed reliance on a judgment of this Court rendered in the case of Umed Singh v. State of Haryana (C.W.P. No. 12450 of 1997, decided on 19.3.1998, Annexure P-1) and argued that the issue raised in the instant petition is similar to the one decided in the aforementioned petition.

In view of above, without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice sent by the petitioners and decide the same expeditiously preferably within a period of two months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed keeping in view the Division Bench judgment of this Court in the cases of Umed Singh v. State of Haryana (C.W.P. No. 12450 of 1997, decided on 19.3.1998, Annexure P-1) and Balwan Singh v. State of Haryana (C.W.P. No.

13552 of 2000, decided on 21.3.2002, Annexure P-2).

Petition stands disposed of in the above terms.
