The petitioner is admittedly working as a Driver on 89 days on consolidated wages ( D.C. rate). His name figured in FIR No.369 dated 21.5.2005/31.8.2005 under Sections 148/149/307/452/323 IPC read with Sections 25, 54/59-A, Arms Act at Police Station, Nuh. Accordingly, he was relieved from his duties.
Having heard learned counsel for the petitioner, we are of the view that the petitioner, who is a contract employee has no substantive right to the post of Driver having been appointed on 89 days on 23.8.2006 (Annexure P-1). The termination of his services by order dated 18.9.2006 does not warrant any interference of this Court as there is no substantive right of the petitioner to hold the aforementioned post. The writ petition is wholly without substance and is dismissed.
