HEMANT GUPTA, J. (Oral)
The petitioner has sought transfer of the petition filed by the petitioner under Section 13 of the Hindu Marriage Act, 1955, pending in the Court of Learned Additional District Judge, Faridkot, to the court of competent jurisdiction at Ludhiana.
It is pointed out that marriage between the parties was solemnized in November, 2005 at Maur Mandi, Bathinda and two children born out of this wedlock who are of 9 years and 8 years of age. It is also pointed out that demand of dowry was raised by the respondent and his family members which led to harassment of the petitioner as well.
Keeping in view the uncontroverted averments made in the transfer petition, I deem it appropriate to transfer the petition under Section 13 of the Hindu Marriage Act, 1955, titled as Sukhdeep Kaur versus Chhinder Singh Dhillon, pending in the Court of learned Additional District Judge, Faridakot, to the Court of learned District Judge, Ludhiana.
It shall be open to the learned District Judge, Ludhiana to entrust the said petition to a court of competent jurisdiction.
C.M. No.18964-CII of 2006
Petitioner through her counsel is directed to appear before the Court of learned District Judge, Ludhiana on 8.12.2006, for further proceedings.
The Court of learned Additional District Judge, Faridkot shall forward the record of the proceedings to the transferee court.
The application stands disposed of accordingly.
