Petitioner Pritam Singh, who is complainant in case FIR No. 65 dated 30.4.2004 under Sections 304-B/498-A/34 IPC, registered at Police Station G.R.P. Hisar, has filed this revision petition against the order dated 2.8.2006, passed by Additional Sessions Judge, Hisar, whereby application filed by the petitioner for framing of alternative charge under Section 302 IPC has been dismissed while observing that at present, there is no evidence to the effect that the deceased was murdered.
After arguing for some time, counsel for the petitioner states that the petitioner may be permitted to withdraw this revision petition with liberty to move an application for framing alternative charge at the subsequent stage, in case some incriminating evidence suggesting that the offence under Section 302 IPC has been committed, comes on record.
Dismissed as withdrawn with the aforesaid liberty.
