Bhupinder Singh has filed this petition under Section 482 of the Code of Criminal Procedure for registration of FIR against respondents No.2 to 8 for trespassing the land of Harjinder Singh, which has been leased out to him.
I have heard counsel for the petitioner and gone through the contents of the petition.
In this case, civil and criminal cases are pending between the parties. The only allegation against respondents No.2 to 8 is that they have trespassed the land of Harjinder Singh, an NRI and the civil court has already granted stay in favour of Harjinder Singh. In view of these facts, I do not find the instant case to be an exceptional case for issuing the direction to register FIR, as in my opinion, the petitioner has alternative civil as well as criminal remedy.
