The plaintiff having concurrently lost before both the Courts below has approached this Court through the present Regular Second Appeal. She filed a suit for mandatory injunction claiming that she was entitled to join the post of sweeper which had been vacated on the death of her mother Smt.Misro.
Both the Courts below have concurrently rejected the claim made by the plaintiff on the ground that no such direction could be issued to the defendants.
The plaintiff has further been non-suited on the ground that the earlier suit filed by the plaintiff has been dismissed under Order 9 Rule 8 of the Code of Civil Procedure, and therefore, a fresh suit was not maintainable. The suit filed by the plaintiff was dismissed and her appeal failed before the learned first Appellate Court.
R.S.A. No. 857 of 2004 
Nothing has been shown that the findings recorded by both the Courts below suffer from any infirmity or are contrary to record.
No question of law, much less any substantial question of law, arises in the present appeal.
