In this revision petition filed by the tenant-petitioner prayer is for setting aside the order dated 3.3.2006 passed by the Rent Controller, Jalandhar whereby an application filed by the petitioner for amendment of the application for leave to contest has been declined.
Learned counsel for the respondent states that he has no objection if the impugned order is set aside and the amendment prayed for by the tenant in the application for leave to contest is allowed.
After hearing learned counsel for the parties and in view of the above, the impugned order dated 3.3.2006 is set aside and the amendment sought by the tenant-petitioner in the application for leave to contest is allowed.
At this stage, learned counsel for the respondent states that the landlord has filed the petition under Section 13-B of the East Punjab Urban Rent Restriction Act, 1949 in March, 2005 and prays for time bound disposal of the case in accordance with law.
In view of the facts and circumstances of the case, it is directed that the Rent Controller shall dispose of the case finally in accordance with law on or before 31.3.2007. This order shall, however, not be taken as an expression of opinion on the merits of the application for leave to contest filed by the tenant-petitioner.
The parties through their counsel are directed to appear before the Rent Controller on 29.11.2006.
Revision petition is accordingly disposed of.
