The petitioner has filed this petition under Section 482 Cr.P.C.
for issuing direction to respondents No.1 to 3 to constitute a Special Investigation Team for proper investigation in case FIR No.78 dated 17.4.2005 registered under Sections 307/120-B/34 IPC at Police Station Balachaur, District Nawanshahr and FIR No.14 dated 29.4.2005 under Sections 302/34/120-B IPC registered at Police Station Pojewal, District Nawanshahr.
Counsel for the petitioner confines his prayer only with regard to FIR No.78 dated 17.4.2005.
I have heard the counsel for the petitioner. In this petition, though it has been stated that the police is not properly investigating the case in FIR No.78 dated 17.4.2005, but no specific allegations of mala fide or bias has been alleged against the local police. Keeping in view the facts and circumstances of the case, I am not inclined to transfer the investigation of the case to some other agency as the same will amount to unnecessary interference in the fair investigation.
As far as the other remedy for providing security, the petitioner may avail her alternative remedy by making a representation to the concerned police officials.
Dismissed with the aforesaid observations.
