Notice of motion to the respondent.
On the asking of the Court, Sh. Sukhdip Singh Brar, learned Additional Advocate General, Punjab accepts notice on behalf of the respondents. Copy of the writ petition has been supplied to the counsel for the respondents.
The petitioner is Residents' Welfare Association, Phase VII, Mohali. They have raised a grievance against an illegal and unauthorised Motor Market in Phase 7, Mohali and have sought directions to the respondents to shift the said motor market.
After hearing the learned counsel for the parties and from the perusal of the record, we find that the petitioners have already served a legal notice dated April 26, 2006 (Annexure P-8) which remains unresponded so C.W.P NO. 15903 OF 2006 2
far. In this view of the matter, without going into the matter any further, we dispose of the present petition with a direction to the Municipal Council, Mohali to take a final decision on the aforesaid legal notice within a period of 4 months from the date a certified copy of this order is received by passing a detailed and speaking order and thereafter take such further action as may be required in accordance with law.
Copy of the order be given dasti on payment of the usual charges.
