Crl. Misc. No. 58565-M of 2006
The petitioner has filed this petition under Section 482 of the Code of Criminal Procedure for quashing of order dated 13.5.2006, passed by Judicial Magistrate Ist Class, Hisar in Criminal Complaint No. 84-1/05 dated 4.6.2005, whereby the petitioner has been summoned to face trial under Section 3 (x) of the S.C. & S.T. (Prevention of Atrocities) Act, 1989 and Sections 341 and 506 IPC.
I have heard counsel for the petitioner and gone through the complaint and the impugned summoning order.
There are specific allegations in the complaint against the petitioner, which constitute the alleged offence. In order to prove the allegations, the respondent himself appeared in the witness box and examined four other witnesses. After considering the prima facie evidence available on record, the petitioner has been summoned to face trial for the aforesaid offences. I do not find any ground to interfere in the impugned order.
