The petitioner along with others filed C.W.P.No.13898 of 2005 which was disposed of by this Court on September 16, 2005 with a direction to the respondents to consider his claim for appointment in the light of various judgments passed by this Court which were referred to in the above- stated order. The claim was required to be decided within three months.
Alleging non-compliance of the above-stated order, this contempt petition has been filed.
In response to the show cause notice, an affidavit has been filed by Mr.R.S.Gujral, IAS Financial Commissioner and Principal Secretary to Government of Haryana, Education Department-respondent No.1 as well as by Mr.Anand Sharma, I.A.S.Director Elementary Education Haryana.
Along with his affidavit, Mr. Anand Sharma has appended a copy of order dated 21.6.2006 (Annexure R-1), whereby the petitioner's claim for appointment has been turned down on the ground that he is at Sr.No.10 in the waiting list of the BC (B) reserved category and candidates upto from Sr.Nos.1 to 7 in the said waiting list only have been given appointment. It is, thus, stated that there are other persons who are higher in merit than the petitioner and are still awaiting their appointments.
In this view of the matter, no further action is required to be taken in these proceedings which are accordingly dropped.
