The petitioner has filed this petition under Section 439 Cr.P.C.
for the grant of regular bail in case FIR No. 83 dated 21.6.2006 under Sections 420/406/506/120-B IPC, registered at Police Station Nihal Singh Wala, District Moga.
I have heard counsel for the parties and gone through the contents of the FIR.
It has been alleged in the FIR that Rs. 8.50 lakhs were given to the Rajinder Singh as shagun at the engagement ceremony of the daughter of the complainant. It is the case of the prosecution that the said amount was given to Rajinder Singh, who had handed over the same to the petitioner, who deposited the same in his bank account.
Counsel for the petitioner contends that all the allegations levelled against the petitioners are false.
The petitioner is in custody since 27.7.2006. Charges have been framed but till date no prosecution witness has been examined. Trial is not going to conclude soon.
Keeping in view the aforesaid facts and without expressing anything on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of trial Court.
